ORDER The petitioner seeks for the release of her son- detenue.
2. Learned Additional Government Advocate, who accepts notice has filed the status report by way of an affidavit of Sri. Harish K. Patel, Circle Police Inspector, Doddapete Circle, Shivamogga. It is narrated therein that the detenue Mahibulla @ Madassir has been arrested in Cr.No.159 of 2016 for the offences punishable under sections 454, 457 and 380 Indian Penal Code and produced before the III JMFC, Shivamogga. The accused was thereafter remanded. Therefore, it is contended that the detenue is in custody in the manner known to law. That he is accused in almost 27 cases in Shivamogga District.
3. In view of the status report being filed, the learned counsel for the petitioner has filed a memo seeking to withdraw the petition. Memo is accepted.
Accordingly, the petition is dismissed as withdrawn.
Learned Addl. Government Advocate to file memo of appearance within four weeks.
