Heard Sri Paritosh Shukla, Advocate holding brief of Sri Dinesh Kumar, learned counsel for the applicant and Sri Ram Chandra, Advocate holding brief of Sri Pranjal Mehrotra, who has filed Vakalatnama on behalf of the respondent no.3.
The present application under Section 482 Cr.P.C. has been filed to quash entire proceeding and the charge-sheet No. 60 of 2018 dated 4.3.2018 in Case Crime No. 14 of 2018, under Section 135 of Electricity Act, Police Station- Didauli, District- Amroha, pending in the court of learned Additional District and Session Judge, Ist, Amroha.
Learned counsel for the applicant submits that the applicant is ready to settle the matter and the applicant is already deposited Rs.10,000/- with the respondent no.2. He also submits that the offence is compoundable and he will compound the offence before the trial court.
Learned counsel for the applicant seeks permission to withdraw the present application with liberty to approach the trial court for compounding the offence.
Learned counsel for the respondent no.3 has no objection the aforesaid prayer.
In view of the facts and circumstances of the case and the submission made by learned counsel for the applicant, the present application is dismissed as withdrawn with liberty to the applicant to move an appropriate application before the trial court for compounding the offence.
Accordingly, the present application is dismissed as withdrawn with liberty as prayed for.
