Heard learned counsel for the petitioner and learned Standing Counsel. Shri P.K. Tripathi holding brief of Shri Mangla Prasad Rai appears for second and third respondent.
The petitioner is before this Court for a direction to third respondent i.e. Basic Shiksha Adhikari, Sonbhadra to provide retiral benefit i.e. pension, gratuity, LIC etc. to the petitioner within stipulated period.
It is contended that petitioner has retired on 31.3.2016 as Assistant Teacher from the institution in question but inspite of his best efforts till today his retiral benefits have not been released by the respondents. For redressal of his grievance he has also made representations dated 1.4.2015 and 10.07.2017 but no action has been taken by the respondents as yet.
Considering the facts and circumstances of the case, without expressing any opinion on the merits of the issue and with the consent, the writ petition stands disposed of asking the third respondent to look into the grievance of the petitioner and in case there is no other impediment, the amount in question would be released to the petitioner within six weeks from today, failing which the petitioner would be entitled for 9% interest on delayed payment.
