Heard learned counsel for the petitioner.
The petitioner and his brother Rakesh had obtained loan. Petitioner's brother had earlier approached this Court by filing a petition being Writ-C No. 24836 of 2014.
This Court had granted relief directing the petitioner to pay the outstanding dues of Rs. 8,84,560 in instalments.
Learned counsel for the petitioner submits that the order of the writ court was not complied and a partial sum of Rs. 2,34,000 was deposited.
The petitioner by the instant writ petition is seeking quashing of the auction notice dated 04.12.2018 to auction the assets of the petitioner to recover the outstanding dues of Rs. 11,84,569/-.
The prayer of the petitioner is that the petitioner is prepared to deposit the entire outstanding dues in instalments.
On specific query, learned counsel for the petitioner is unable to explain as to why the earlier order passed by this Court has not been complied, further, the petitioner is seeking six months time to deposit 25% of the outstanding dues.
In view thereof, this Court is not inclined to entertain the present writ petition.
The writ petition is, accordingly, dismissed with liberty to the petitioner to deposit the entire sum before the concerned authority.
