The instant petition has been filed for a mandamus directing the Labour Commissioner to resolve the industrial dispute raised by the petitioner by petition dated 19.5.2019 as envisaged under Section 4(1) of the Industrial Disputes Act, 1947.
Section 4(1) of the Industrial Disputes Act, 1947 provides that the appropriate Government may by notification in Official Gazette appoint such number of persons as it thinks fit as conciliation officers, charged with the duty of mediating in and promoting the settlement of industrial disputes.
Counsel for the petitioner admits that the Labour Commissioner has sent a communication to the Assistant Labour Commissioner on 6.8.2019 calling for his comments on the basis of complaints dated 8.5.2018 and 29.4.2018 alleged to have been made by the petitioners.
Since the Labour Commissioner is already seized of the matter and, therefore,no mandamus is required to be issued by this Court. The authorities under the Act have to carry out their duty as per the provisions of law.
The petition stands disposed of accordingly.
