Heard learned counsel for the applicant and leaned AGA for the State.
The present criminal revision has been filed to quash the order dated 16.05.2018 passed by the A.C.J.M.-I, Mirzapur in Complaint Case No. 137 of 2018 (Hriday Narayan Singh Vs. Vivek Pandey and another), under Section 420 I.P.C., Police Station- Kotwali Dehat, District- Mirzapur as well as to direct the learned Court below to restrain the opposite party nos. 2 and 3 not to create any hindrance in peaceful plying of Vehicle No. U.P.-63-T/0588 by the applicant till disposal of Complaint Case No. 137 of 2018 (Hriday Narayan Singh Vs. Vivek Pandey and another), under Section 420 I.P.C., Police Station- Kotwali Dehat, Distrcit- Mirzapur.
Learned counsel for the applicant states that the present criminal case has been filed by the applicant seeking injunction against the Hinduja Leyland Finance Company not to create hindrance in peaceful plying of the vehicle namely the truck bearing registration no. U.P.-63-T/0588.
In view of such nature of prayer sought, it is clear that the application filed by the applicant was wholly misconceived. No such prayer could have been granted.
Leaving it open to the applicant to initiate appropriate proceedings as he may be advised, the present application lacks merit and is accordingly dismissed.
