The present Civil Application has been filed for condonation of delay of 1 day under Section 5 of the Limitation Act on the grounds stated in the Application in filing the Appeal.
Heard learned Advocate Mr. H.H.Parikh for the Applicant and learned Advocate Mr. H.H.Prajapati for the Caveator.
In the facts and circumstances, the ground made out can be said to be sufficient cause to condone the delay. Therefore, considering the guidelines laid down by the Hon'ble Apex Court with regard to approach in such matters of condonation of delay, the present Civil Application deserves to be allowed and accordingly stands allowed. Delay is condoned. Rule is made absolute.
The main matter is ordered to be placed on board on 10th May, 2012.
