1. It appears that this application i.e. Misc. Civil Application (for orders) No.2526 of 2012 is placed before this Court in view of the office note dated 11.12.2012.
2. It is, however, necessary to clarify that the matter is not treated as part-heard by this Court. Actually effective and substantive hearing of the application had yet to begin. Furthermore, the direction and undertaking of which reference is made and the relief prayed for by the applicant in present application is concerned, it arises from and on account of and pursuant to the order dated 5.11.2009 passed by the Hon'ble Court (Coram: Honourable Mr. Justice K.S. Jhaveri) and not by this Court.
3. Under the circumstances, the application ought to be listed in regular course before the Hon'ble Court where the subject matter of the petition are assigned as per present roster and not before this Court which is assigned the subject of Misc. Cri. Application u/s 482 of Cr. PC & Special Criminal Applications under Article 226 & 227 of the Constitution.
4. Therefore appropriate action may be taken and the matter may be listed before the Court where the subject matter of the petition is assigned as per present roster.
