The sole relief claimed in the instant petition is for issuing direction to the trial court to decide Original Suit No.294 of 2000 within a stipulated time.
The said suit has been filed by the petitioner against the defendant/respondents for specific performance of an agreement for sale. According to learned counsel for the petitioner, the defendants are delaying the disposal of the proceedings. He points out that the defendants have also filed an application for amendment in the written statement to delay the disposal of the suit.
Having regard to the facts of the case and the submissions made, the petition is disposed of by directing the trial court to forthwith proceed to decide the amendment application and thereafter make endeavour to decide the suit itself expeditiously, without granting unnecessary adjournments.
