This appeal is pending in this Court from last more than 24 years. Continuously illness slip is being sent by Sri Y.D. Sharma, learned counsel for the appellant. The name of other three counsels are also shown in the cause list but none appears even in the revised call.
By the impugned common judgement dated 23.5.1988, Eighty Seven Land Acquisition References were decided by the reference court determining compensation @ Rs.21,000/- per bigha for the land acquired by notification dated 19.12.1980, under Section 4(1) of the Land Acquisition Act,1894 (hereinafter referred to as the 'Act') published in the Gazette dated 28.3.1981. Notification under Section 6 of the Act, was simultaneously published. The possession of the land was taken on 5.1.1981. The award was passed by the Special Land Acquisition Officer on 5.1.1982 for the land measuring total 782 bighas 16 biswas 19 biswansi. The land was acquired for construction of Okhla Barrage on Yamuna River towards the side of Ghaziabad situate in village Chhalera Khadar.
Since, none of the other learned counsel for the appellants has appeared even in the revised call and Sri Y.D. Sharma, Advocate is regularly sending illness slip, therefore, the present appeal being a very old first appeal is dismissed for non prosecution.
