Heard Shri Manvendra Nath Singh, learned counsel for the petitioners, learned Standing Counsel for the State respondents and Shri Diwakar Singh, learned counsel for third respondent.
The petitioners are before this Court with request to issue direction to the Sub Divisional Magistrate, Sadar, District Allahabad to carry out necessary correction under Section 33/39 of UP Land Revenue Act, 1901 in revenue record and accordingly the order of the Commissioner passed in the proceedings under Section 210 of L.R. Act dated 09.09.2016 may be complied with, expeditiously.
Learned counsel for the petitioners has apprised that at no point of time the validity of the order dated 09.09.2016 has been assailed by the parties to the lis and the same has attained finality but in spite of their best efforts, the name of the petitioners have not been mutated in the revenue records till date. He has further apprised to the Court that for the said purpose, petitioners have again approached to the fourth respondent on 20.11.2017 but nothing has been done in the matter.
Learned Standing Counsel and Shri Diwakar Singh, Advocate very fairly state that in case the aforesaid proceeding is still pending, the same shall be carried out by the Authority concerned expeditiously.
In view of the above, without expressing any opinion on the merits of the case and considering the facts and circumstances of the case, on consent, the writ petition is disposed of finally with a direction to the Sub Divisional Magistrate, Sadar, District Allahabad to finalize the aforesaid proceeding expeditiously, preferably within a period of three months from the date of production of a certified copy of this order before him, without granting unnecessary adjournments to either of the parties, except upon payment of cost.
