In terms of order dated 19.9.2017 in Writ-C No.43695 of 2017, the Managing Director, U.P.S.I.D.C. was under mandate to decide application of the applicants seeking waiver of interest within a period of four weeks from the date of the order, provided a certified copy of the order of the Writ Court alongwith copy of the writ petition is served upon him within one week.
Counsel for the applicants submitted that on 25.9.2017 the required documents alongwith certified copy of the order of the Writ Court was served in the office of the opposite party, but no decision has been taken by him so far. He further submitted that several reminders were also sent but no heed was paid.
This Court is of the opinion that before inaction on part of the opposite party in complying with the above direction is treated as wilful disobedience of the order of the Writ Court, one more opportunity be granted to them to ensure compliance of the said order.
Accordingly, the instant contempt application is disposed of with liberty to the applicants to file a certified copy of this order alongwith fresh representation before the opposite parties and in which event, they shall ensure that decision in due compliance of the direction issued by the Writ Court is taken within next three weeks. In case the decision is yet not taken, as directed herein, it shall be open to the applicants to initiate fresh contempt proceedings.
