Heard learned counsel for the parties.
Petitioner is working as Food Safety Officer. Petitioner vide order dated 23 January 2019, came to be posted/transferred at Tehsil Bijnor from Tehsil Dhampur, District Bijnor. Aggrieved petitioner approached this Court by filing a writ petition being Writ - A No.2122 of 2019 (Hitendra Pal Singh Vs. State of U.P. and others) wherein, the following order was passed on 11 February 2019:
"Heard learned counsel for the petitioner and learned Standing Counsel.
Learned counsel for the petitioner chooses not to press this writ petition subject to liberty being reserved to represent the District Magistrate in respect of his grievances.
Order accordingly."
Learned counsel for the petitioner informs that on the representation, petitioner has been shifted from Tehsil Bijnor to Nagar Palika, Bijnor vide order dated 27 February 2019.
On specific query, learned counsel for the petitioner informs that the transfer/posting is within District Bijnor.
In view thereof, this Court declines to interfere in exercise of its discretionary jurisdiction under Article 226 of the Constitution of India.
The writ petition is, accordingly, dismissed.
