In addition to what is recorded on 26.3.2012, respondent No.2 is ranked outsider and has no title, ownership, occupancy or possessory right and even the trust has no locus to enter into the premise belonging to Dineshbhai who died and the applicants are admittedly legal heirs and ought to continue and should continue to occupy the premises. The impugned complaint is nothing but abuse of process of law.
Hence, Rule. Learned APP, waives service of rule on behalf of respondent NO.1 and Mr. A.D.Oza, learned advocate, for respondent No.2. Interim relief granted earlier to continue till further order.
