Rule.
The present application has been filed by the applicant-original opponent for the prayer that the Registrar of this Court may transfer the amount deposited in the Nationalized Bank pursuant to order passed by this Court dated 30.04.1996 to the Civil Court (SD), Himmatnagar in view of the subsequent development as stated in the application.
Heard learned counsel, Mr.J.V. Japee for the applicant and learned counsel, Mr.N.L. Ramnani.
It has been stated by learned counsel, Mr.Japee that in view of the amendment in the Gujarat Civil Courts Act, the Appeal has been transferred to the District Court and accordingly amount, which has been deposited, is required to be transferred to the District Court, to which, learned counsel, Mr.Ramnani has no objection.
Therefore, prayer in terms of Para No.7(b) is granted and the amount, which has been deposited with the registry of this Court as per the order dated 30.04.1996 produced at Annexure-A, is ordered to be transferred to the Civil Court (SD), Himmatnagar.
With the above, the present application stands allowed accordingly. Rule is made absolute.
