JUDGMENT / ORDER

It is brought to my notice that the appellant company has been wounded up by, an order of the Hon'ble High Court, Delhi, made in C.P.No.49 of 2002 dated 28.09.2006. Further it is represented that Vide order dated 28.09.2006, the Hon'ble High Court, Delhi directed to appoint Senior Officer of a Public Sector Undertaking as a Liquidator. Pursuant to the same, Mr.B.S.Mohapatra, Chief General Manager (Finance) of Food Corporation of India, New Delhi, has been appointed as Liquidator on 15.01.2007. The said liquidator has not taken any steps to get himself substituted in this appeal and the learned counsel appearing for the appellant is also unable to get any instructions from the Liquidator. Hence, the Appeal is dismissed as non-prosecution.
