Heard learned counsel for the parties.
The short question arising in this petition is whether the provisions of the Minimum Wages Act, 1948 are applicable to Hindi Sahitya Sammelan which is a society registered under the Societies Registration Act,1860 and is claimed to be an educational institution in respect whereof there is no notification under Section 27 of the Act.
Sri K.S. Kushwaha, learned counsel appearing for respondent no. 2 prays for and is allowed three weeks time for filing counter affidavit.
List for admission/final disposal immediately thereafter.
Until further orders of this Court, amount of Rs. 1,28,547/- pursuant to the impugned order dated 20.9.2013 shall not be realized from the petitioner provided it is deposited by the petitioner with the Labour Court, Allahabad within a period of two weeks from today. On the deposit being made, the same shall be kept in a short term fixed deposit subject to the decision of the writ petition.
