The prayer made in the instant petition is for mandamus commanding the respondent authority to remove the alleged illegal encroachment made by respondent Nos. 7 to 18 over the Arazi No. 1034, area 0.340 hectare, village Ram Nagar, Tehsil Bhadohi, District Bhadohi with a stipulated period.
The petitioner is relying upon the report dated 25.6.2019 submitted by Revenue Authorities in compliance of order of Tehsildar, Bhadohi wherein he has prayed for police force being provided to him to facilitate dispossession of the private respondents who are found to be in illegal possession.
It is evident that proceedings are pending before the Tehsildar. The petitioner also claims to have moved to the District Magistrate to restore his possession. In such circumstances, there arises no occasion for this Court to entertain the claim relating to restoration of possession in exercise of writ jurisdiction.
The writ petition is, accordingly, dismissed.
