Heard Sri Ashok Khare learned Senior Counsel for the petitioner and Sri S.C. Upadhyay learned Brief Holder for the State.
This petition has been preferred for inclusion of the petitioner and consideration of his claim for promotion on the post of Naib Tehsildar. From the record it is pointed out that the petitioner was appointed as Revenue Inspector on 31 May 2016. In terms of Rule 5 of the 1994 Rules it is contended that the petitioner is entitled to be considered for promotion to the post of Naib Tehsildar having been substantively appointed as a Revenue Inspector and having completed two years of service. Presently the respondents have not disclosed any reason why the petitioner's claim would not merit consideration.
In view of the above, Sri Upadhyay appearing for the second respondent states that subject to verification of all facts and contentions on merits being left open, the claim of the petitioner shall be duly attended to and disposed of by the said respondent in accordance with law and a formal decision with respect to the entitlement of the petitioner communicated to him within a period of three months from the date of presentation of a certified copy of this order.
Accordingly and without going into the merits of the claim of the petitioner, this petition shall stand disposed of in light of the statement noted above.
