Heard learned counsel for the applicants, learned AGA and perused the record.
By means of the instant petition, the applicants have prayed to set aside the order dated 20.10.2018 passed by FTC/Additional Sessions Judge, Kanpur Nagar whereby rejecting the application filed under 67 Kha, the applicants have been summoned in S.T. No. 428 of 2014 (State v. Hemandr Niranjan and others) arising out of Case Crime No. 569 of 2011 for the offence under sections 498-A, 304-B IPC and 3/4 of the Dowry Prohibition Act, P.S. Panki, District Kanpur Nagar as well for staying the entire criminal proceedings initiated therein.
At the out set, the aforesaid prayers made on behalf of the applicants seems to be misconceived as according to the leaned counsel for the applicants himself, all the witnesses of fact have already been examined. The matter is ripe for adjudication and disposal, therefore, the prayer sought for is outrightly rejected.
However, keeping in view the facts and circumstances of the case, the learned trial court is directed to dispose of the aforesaid case expeditiously, latest by 30.06.2019, without granting any unnecessary adjournment to either of the parties, if there is no other legal impediment.
With the aforesaid observations the petition under section 482 Cr.PC is disposed of.
