Learned Advocate Mr. Shelat urges that at initial stage, present petitioner was protected by way of interim injunction in terms of maintenance of status quo in respect of the suit property, which continued for a long time. However, the same has been discontinued by the Appellate Court by an order impugned. He seeks to rely upon the decision of the Apex Court in case of Ravi Prakash Agarwal vs. Rajesh Prasad Agarwal, reported in (2008) 12 SCC 144.
Notice be issued to the otherside returnable on 12th June, 2012. In the meantime, no further transfer shall be effected in respect of the suit property. Direct Service is permitted.
