[1] Present application is filed by the convict, which is supported by the affidavit sworn by his father. The application is filed seeking temporary bail for a a period of 30 days on the ground of sickness of his father.
[2] Rule.
Learned Additional Public Prosecutor Mr.H.K.Patel waives service of process of Rule.
[3] Learned Additional Public Prosecutor made available for perusal the Jail Remarks. The convict is undergoing life imprisonment for the offences punishable under sections 302 of IPC and under section 25(1)(A)(B) of the Arms Act in Sessions Case No.86 of 2006. The convict has by now undergone 6 years, 2 months and 4 days. He has enjoyed one temporary bail. The convict has enjoyed two furlough leave and every time he has reported in time. There is no adverse recorded in the jail remarks.
[5] Taking into consideration the contents of the application, the application is allowed. The convict is ordered to be released on temporary bail for a period of 30 days from the date of his release, on his executing a personal bond of Rs.5,000/- (Rupees Five Thousand only) to the satisfaction of the jail authorities.
[6] The convict shall surrender to the jail authorities on expiry of the temporary bail period.
[7] Rule is made absolute to the aforesaid extent.
[8] Direct service is permitted, today.
