This application has been filed with a prayer to direct the court below to hear and consider the bail application in the light of larger bench judgement of Hon'ble Apex Court in case of Lal Kamlendra Pratap Singh vs. State of U.P. and judgement of this Court in Case of Amrawati vs. State of U.P. in pursuance of Case Crime No. 342 of 2018 under Section 3/4 of the Public Gambling Act, 1987, P.S. New Agra, District Agara.
Admittedly the investigation is still pending and no process of court has yet begun. As such, this Application under Section 482 Cr.P.C. is not maintainable.
Accordingly, the Application is dismissed as not maintainable.
It is open to the applicant that he may avail such remedy as available under the law.
