Heard Mr. Arun Kumar Singh, learned counsel for the applicant and the learned A.G.A. for the State.
This application under section 482 Cr. P. C. has been filed challenging the order dated 23.3.2 018 passed by the Additional Court, Bijnor in Complaint Case No. 1118 of 2016 (Rajesh Singh Versus Himanshu Arya) under section 138 N.I. Act, P.S. Kotwali Sahar, District Bijnor, whereby Court below issued non-bailable warrants to the applicant as well as the notices to the sureties fixing 25.4.2018 for personal appearance.
From the record, the Court finds that the Court below, vide order dated 29.11.2017 had rejected the application for exemption filed by the applicant and further observed that 7 opportunities were granted to the accused to give his statement, but the accused has been taking adjournment on the last three days.
Looking into the conduct of the applicant as evident from the order dated 29.l1.2017 as well as the subsequent orders, no case for interference is made out.
The application is, accordingly, dismissed.
