Court No. - 58
Case :- WRIT - A No. - 13244 of 2018 Petitioner :- Himalaya Sharma Respondent :- State Of U.P. And 2 Others Counsel for Petitioner :- Birendra Kaushik Counsel for Respondent :- C.S.C.
Hon'ble Ashwani Kumar Mishra,J.
Petitioner is aggrieved by an order of transfer dated 25.5.2018, whereby he has been transferred from Mathura to Balrampur. This order is challenged on the ground that petitioner's father is not keeping in good health and is attended by doctors at Delhi.
Petition is opposed by learned Standing Counsel.
Admittedly, petitioner holds a transferable post and transfer is otherwise an incidence of service. Petitioner has otherwise not disclosed as to when since he is continuing at Mathura. In such circumstances, no interference by this Court is called for.
However, in the facts and circumstances, it is observed that in case petitioner joins at the transferred place, he shall be at liberty to make a representation ventilating his grievances, which shall be dealt with by the authority concerned in terms of the policy framed for the purpose.
With the aforesaid observations, this writ petition stands disposed of.
