High Court Of Kerala

The Kerala high court functions with respect to Article 226 of the Indian constitution. It is authorised to provide directions and writ for Habeas corpus, Mandamus, Prohibition, and Quo warranto. 

The primary objective of such measures is to ensure the enforcement of citizens' Fundamental Rights, as guaranteed by the constitution, or for other stated purposes. The Kerala High Court was established on 1 November 1958, and its functions are justified by the Kerala High Court Act of 1958. This Act grants the Kerala High Court all the powers of a high court in Kerala. The foundation stone for the new multi-story Kerala High Court building in Cochin was laid by Chief Justice, MN. Venkatachaliah.

Jurisdiction of Kerala High Courtt

As per the latest advancement the Kerala High court observed that it is due to the lack of protocols and systemic failure murder of a 23 year old house surgeon happened in Kottarakkara Kollam. 

‘As far as the incident in question is consent there can be a little doubt that the killing of a doctor by a person in custody of police be that as an accused in any other capacity points strongly at a systemic failure. The police officers were also ad idem that it is the fundamental duty of any officer to have guarded citizen even at the cost of their own lives.’  

The above statement was mentioned by the division bench encompassing  Justice Devendra Ramachandran and Justice Kauser Edappagath. This latest Kerala High Court judgement went viral.

<b> Did you know:</b> On 21 February, 2023 which is also recognised as International Mother Language Day, the Kerala High Court made history by publishing two of its recent judgments in the Malayalam language. The Kerala High court is the first High court in the country to publish the judgments in a regional language. The official website of the Kerala High court was updated with the Malayalam versions of the judgements along with the English version. The judgement was passed by a division bench including chief justice S.Mani Kumar and justice Shaji .P. Chaly.

The prayer in this Crl.M.C is as follows: “To issue an Appropriate order directing the 2nd Respondent to conduct an effective investigation on Annexure A2 FIR and submit final report before Judicial First Class Magistrate Court-II, Nedumangad within three months.”2. As directed by this Court, the 2nd respondent-Investigating Officer in the crime concerned has filed a statement dated 25.7.2015. It will be profitable to go through the contents of the statement which reads as follows:“1.  It is humbly submitted that, the case in brief is that, on 18.12.2003, the accused Krishnakumari, Melethil Veedu, Kaliyal, Karama, working as a treasurer in Taluk Head Quarters Hospital, Nedumangas during the period 2003 has availed a loan from Kerala Gazetted Officers Society by submitted a salary certificate of herself and making the complainant as a surety.  But the salary certificate submitted by the accused was a forged one by forging her date of birth as 26.12.1954 instead of her original date of birth 26.12.2009 and her retirement date as 31.12.2007 instead of 31.12.2009. In addition to this, the accused had not repayed the loan instalments till her retirement from the service. After this, a notice was sent from the society to the surety for recovering the entire loan amount. Soon he approached the Court for seeking redressal of his grievances. Thus the ::2::

The above captioned Crl.M.C. has been filed under Sec.482 of the Code of Criminal Procedure with the following prayers: “ (a)  Direct the court below to recall the warrant issued against the petitioner Or (b)  Give a direction to the court below to consider the application for bail of the petitioner on the date of surrender of the petitioner so as to enlarge him on bail, in C.C.967/2015 of JFCM-II, Ernakulam.”2. Heard  Sri.John  S.Ralph,  learned  counsel  for  the petitioner and the learned Public Prosecutor appearing for the respondent-State of Kerala.

The appellant herein was Tax Assistant in the office of the Additional Commissioner of  Income Tax Office, Kollam in  December,  2004.  He  faced  prosecution  before  the learned Special Judge (SPE/CBI-I), Ernakulam in C.C. 7 of 2005, on the complaint of one Balachandran Pillai, that on 13.12.2004, the appellant accepted an illegal gratification of ₹ 2000/- from him as a reward for issuing a cheque for the  refund  of  an  amount  of  ₹ 17,326/-.  The  said Balachandran Pillai had sustained some injuries in a motor accident on 21.6.1995.  On the claim brought by him as O.P.  (MV)  No.520/1997,  the  Motor  Accidents  Claims Tribunal, Kollam awarded a compensation of ₹ 2,90,000/- with interest.  The Insurance Company assessed the total amount inclusive of interest as ₹ 4,63 261/-, and deposited an amount of ₹ 4,45,935/- in court, after deducting an amount of ₹ 17 326/-, as income tax.   When the said Balachandran Pillai got legal advice that such deduction is not legal, he approached the Insurance Company for refund of the said amount.  The Insurance Company instructed him to approach the Income Tax Office with necessary request. On 8.12.2014,  Balachandran  Pillai  approached  the  appellant herein  in the Income Tax Office at Kollam along with an Advocate Clerk, by name Sarjan.  The case of Balachandran Pillai is that when he made request on 8.12.2004 for refund of the amount, the appellant demanded an amount of ₹ 5000/- as bribe.

Petition filed under Section 438 Cr.P.C. 2. Petitioner  is  accused  in  Crime  No.204  of 2011 of Chittur Police station registered for the offences under Secs.120B abd 420 read with Sec.34 of the Indian Penal  Code  and  Secs.4,5  and  6  if  the  Prize  Chits  and Money   Circulation   Schemes   (Banning   Act).   The prosecution case is that the petitioner also took part in the activities of the company which was engaged in the business of prize chits and money circulation illegally.3. Heard both sides.

Petition filed under Section 439 Cr.P.C. 2. Petitioner is accused in Crime No.601 of 2015 of Palode Police station registered for the offences under Secs.294(b), 307, 323 and 341 of the Indian Penal Code. The prosecution case is that the petitioner uttered obscene words, wrongfully restrained the first informant, assaulted him and stabbed him with a knife causing him serious injuries.3. Heard both sides.4. The petitioner has been in custody since 13.07.2015. It appears that his further detention is not necessary for completion of the investigation. So I am inclined to grant the prayer of the petitioner.

Petition filed under Section 439 Cr.P.C. 2. Petitioner is accused in Crime No.714 of 2015 of Vallikkunnam Police station registered for the offences under Secs.143, 147, 148, 294(b), 307, 323, 324, 342, 365 and 427 read with Sec.149 of the Indian Penal Code.  The prosecution case is that the petitioner along with  the  co-accused  kidnapped  the  victim,  wrongfully confined him and assaulted  him with the intention of causing his death.3. Heard both sides.4. The  petitioner  has  been  in  custody  since 08.07.2015. The weapon used is only a wooden reaper. Having regard to these facts, I am inclined to grant the prayer of the petitioner.

Petition filed under Section 439 Cr.P.C. 2. Petitioner  is  accused  in  Crime  No.288  of 2015 of Kattoor Police station registered for the offences under Secs.376, 406 and 420 read with Sec.34 of the Indian Penal Code and Sec.3(1)(x)(xii) of the Scheduled Caste and Scheduled Tribe (Prevention of Atrocities) Act. The prosecution case is that the petitioner made a false promise to the victim, who belongs to a scheduled caste that he would marry her, had sexual intercourse with her and now he has refused to marry her.

Petition filed under Section 438 Cr.P.C. 2. Petitioner  apprehends  arrest  in  Crime No.998 of 2014 of Mangalapuram Police station.3. No representation for the petitioner.4. Copy of the bail application has not been served on the Public Prosecutor.In the result, the bail application is dismissed.Sd/-K. Petition filed under Section 439 Cr.P.C. 2. Petitioner is accused in Crime  No.1564 of of  2015  of  Thiruvalla  Police  station  registered  for  the offences  under  Secs.143,  147,  149,  286,  307,  324,  436 and 449 of the Indian Penal Code. The prosecution case is that the petitioner along with the co-accused armed with deadly weapons assaulted the victim in an attempt to kill him and set fire to his house.3. Heard both sides.4. The Police have registered a case against the victim and others also. The petitioner has been in custody since 13.07.2015. His further detention is not necessary for completion of the investigation. So I am inclined to grant the prayer of the petitioner.

Petition filed under Section 439 Cr.P.C. 2. Petitioners are accused in Crime No.798 of of 2015 of Perinthalmanna Police station registered for the offences under Secs.143, 147, 148, 118 and 302 read with Sec.149 of the Indian Penal Code. The prosecution case  is  that  the  accused  armed  with  deadly  weapons formed  themselves  into  an  unlawful  assembly  and committed murder of one Abdul Latheef.3. Heard both sides.4. Learned  counsel  submits  that  the  only allegation against the petitioners is that they failed to inform the Police about the commission of the offences though they knew about it.
