High Court Of Kerala

The Kerala high court functions with respect to Article 226 of the Indian constitution. It is authorised to provide directions and writ for Habeas corpus, Mandamus, Prohibition, and Quo warranto. 

The primary objective of such measures is to ensure the enforcement of citizens' Fundamental Rights, as guaranteed by the constitution, or for other stated purposes. The Kerala High Court was established on 1 November 1958, and its functions are justified by the Kerala High Court Act of 1958. This Act grants the Kerala High Court all the powers of a high court in Kerala. The foundation stone for the new multi-story Kerala High Court building in Cochin was laid by Chief Justice, MN. Venkatachaliah.

Jurisdiction of Kerala High Courtt

As per the latest advancement the Kerala High court observed that it is due to the lack of protocols and systemic failure murder of a 23 year old house surgeon happened in Kottarakkara Kollam. 

‘As far as the incident in question is consent there can be a little doubt that the killing of a doctor by a person in custody of police be that as an accused in any other capacity points strongly at a systemic failure. The police officers were also ad idem that it is the fundamental duty of any officer to have guarded citizen even at the cost of their own lives.’  

The above statement was mentioned by the division bench encompassing  Justice Devendra Ramachandran and Justice Kauser Edappagath. This latest Kerala High Court judgement went viral.

<b> Did you know:</b> On 21 February, 2023 which is also recognised as International Mother Language Day, the Kerala High Court made history by publishing two of its recent judgments in the Malayalam language. The Kerala High court is the first High court in the country to publish the judgments in a regional language. The official website of the Kerala High court was updated with the Malayalam versions of the judgements along with the English version. The judgement was passed by a division bench including chief justice S.Mani Kumar and justice Shaji .P. Chaly.

Petition filed under Section 438 Cr.P.C.2. Petitioner is the accused in Crime No.1005 of 2015 of Mannuthy Police Station, Thrissur District. He is said to have committed the offences under Sections 323, 324, 354, 452, 506(ii) of the Indian Penal Code.3. The prosecution case is that he trespassed into the victim's house, threatened and assaulted her with an iron road.4. Heard.5. The victim did not sustain any serious injuries.The incident happened during day time.  The incident arose out of a family dispute. Having regard to these facts I am inclined to grant the prayer of the petitioner for anticipatory bail.

Petition filed under Section 438 Cr.P.C.2. Petitioners are the accused in Crime No.427 of 2015 of Payyoli Police Station, Kozhikode District. They along with the co-accused is accused of having committed the offences under Sections 419, 420, 468 and 471 read with Section 34 of the Indian Penal Code.3. They are juveniles. Under the Juvenile Justice (Care & Protection of Children) Act they are entitled to bail unless detention  is  beneficial  to  them.  So  it  is  not necessary to invoke the jurisdiction of this court under Section 438 Cr.P.C.

Petition filed under Section 438 Cr.P.C.2. Petitioner is the 5th accused in Crime No.724 of 2015 of Kottiyam Police Station, Kollam District. He along with the co-accused is accused of having committed the offences under Sections 143, 147, 148, 2949b), 324, 326, 307 read with Section 149 of the Indian Penal Code.3. The  prosecution  case  is  that  the  accused assaulted the victim with a cricket bat and stump causing fracture of his frontal bone.4. Heard.5. It appears that the assault was not a pre- planned one.  There is no allegation that the petitioner used  any  weapon.   The  weapon  has  already  been recovered. Having regard to these facts I am inclined to grant the prayer of the petitioner for anticipatory bail.

Petition filed under Section 438 Cr.P.C.2. Petitioner is the accused in Crime No.318 of 2015 of Kottiyam Police Station, Kollam District. He is the accused of having committed the offence under Section 376 of the Indian Penal Code and Sections 3(1) (xi) and 392) (v) of SC/ST Prevention of Atrocities Act.3. The prosecution case is that he made a false promise to the victim, who belongs to a scheduled caste that he would marry her and took her to a temple and garlanded her and made her believe that the marriage was solemnized between them. Thereafter, he had sexual intercourse with her. Later, he failed to contact her either directly or directly. He made himself scarce.

Petition filed under Section 438 Cr.P.C.2. Petitioner is the accused in Crime No.348 of 2015 of Pothukal Police Station, Malappuram District. He is said to have committed the offences under Sections 4 (1) (a) (b) 7(1)(c ) of Liquefied Petroleum Gas (Regulation of Supply and Distribution) Order 2000 and Section 3 and 7(1) (a) (ii) of Essential Commodities Act.3. The prosecution case is that he was found to be in possession of 10 LPG cylinders and equipment used for filling empty cylinders.4. Heard.

It  is  submitted  by  counsel  for  the  respondent  that  the directions  in  the  judgment  dated  11.03.2011  in  Writ  Petition No.2849 of 2011 have been complied with, through the passing of an order dated 30.07.2015. This fact is not disputed by the counsel for the petitioner.  Accordingly, taking note of the fact that the respondent  has  since  passed  an  order  dated  30.07.2015  and disbursed  an  amount  of  Rs.1,84,601/-  to  the  petitioner,  the Contempt of Court case is closed. The issue is covered by Raveendran v. State of India [2015 (3) KLT 210].  It has been held therein that the proceedings will not lapse. An Award would be passed only after the rules are framed under the Right to  Fair  Compensation  and  Transparency  in  Land Acquisition,  Rehabilitation  and  Re-settlement  Act, 2013.  No case for initiating proceedings under the Contempt of Courts Act exist. The Contempt Proceedings are hence dropped.nj.Sd/-V.CHITAMBARESH, Judge.

The matter in issue raised in this Criminal Miscellaneous Case  is  covered  against  the  respondent-State  by  the  legal principles laid down by this Court in Santhosh v. State of Kerala reported in 2014(3) KLT 837 as well as the judgment dated 19.12.2014 of this Court rendered in the case Sajeesh.K v. State of Kerala in Crl.M.C.No.7259/2014 and connected cases reported in 2014 SCC Online Ker. 27899 dealing with similar impugned proceedings under Sec. 107 of the Cr.P.C. The impugned order in this case is similar or almost identical to the one considered in the above said reported rulings of this Court. 2.   Accordingly, in tune with the directions issued by this Court in the said reported decisions, the impugned order in this case is quashed with liberty to the Sub Divisional Magistrate concerned  to  take  fresh  action,  if  actually  necessary,  after complying with all the statutory procedural requirements and after applying the legal principles laid down in the aforementioned Crl.M.C.No.4913 of 2015           2 reported rulings of this Court and in accordance with law.
