COMMON ORDER:
This Company Petition is filed for an order to wind up the respondent for non-payment of the debt due to the petitioner.
This Court by order, dated 17.06.2014, admitted the Company Petition. The petitioner filed Company Application No.1124 of 2013 under Rule 100 of the Companies (Court) Rules, 1959 for leave to the petitioner to withdraw the Company Petition. In support of this Company Application, it is stated by Sri Hema Shivananda, the Company Secretary of the petitioner- Company, that after the admission of the Company Petition, both the parties have reached to an amicable settlement and that therefore, the Company Petition may be dismissed as settled out of Court.
In the light of the above, the Company Application is allowed. Order, dated 17.06.2014, is recalled and consequently, the Company Petition is dismissed.
As a sequel to dismissal of the Company Petition, Company Application Nos.206 and 207 of 2013 are disposed of as infructuous.
