JUDGMENT / ORDER

1. By way of this application, the applicant has prayed for the following reliefs:-
(a) that the passport i.e. S5720895, surrendered vide order passed in CrMA- 151/15 order dated 7.3.15 be ordered to be released and returned to the petitioner on any terms and conditions which he will strictly adhere-to;
(b) that Your Lordship be pleased to direct the respondent no.2 to renew a passport of the petitioner for the period of 5 years.
(c) that Your Lordship be pleased delete the condition of depositing Rs. 2,00,000/- as security against the release of the passport;
(d) that your lordships be pleased to pass such other and further relief that is just, fit and expedient in the facts and circumstances of the case may be granted.
2. RULE. 3. It is the case of the applicant that the applicant wants his passport renewed for a period of five years. Learned advocate Mr.Anandjiwala for the applicant, at the outset, upon instructions, states that he is not praying the prayer made in paragraph no. 8 (c) which is in respect of depositing Rs. 2,00,000/- as security against the release of the passport.

Considering the fact that the applicant wants to release the passport only for the purpose of renewal and as and when, the applicant wants to go abroad as stated by learned advocate Mr. Anandjiwala, the applicant shall approach the concerned Court. The aforesaid prayer for releasing the passport is required to be considered in light of the aforesaid submission.
5. Learned advocate Mr. Kshitij Amin appearing for the Regional Passport Authority states that the applicant's application for renewal of passport for a period of five years shall be considered sympathetically in accordance with rules and regulations of the Central Government.
6. Considering the aforesaid assurance given by learned advocate Mr. Amin, the passport of the applicant bearing no. S5720895 be released upto 31.05.2023 with a condition that once the Page 2 of 3 Downloaded on : Fri Apr 21 21:02:19 IST 2023 R/CR.MA/6641/2023 ORDER DATED: 21/04/2023 passport is renewed, the present applicant shall surrender the renewed passport within a period of one week from the date of receipt of the said passport.
7. With the aforesaid direction, the present application is disposed of.
