JUDGMENT / ORDER

1. Learned advocate, Mr.Vikram J.Thakor, for the petitioners has stated at the bar that learned advocate, Mr.H.M.Prachchhak for the respondent, who is not present before this Court, has no objection to dispose of this matter by passing an order to the effect that both the parties will maintain status quo qua disputed suit property till final disposal of the suit and modify the order passed by the trial court dated 30-6-2011 by the learned Principal Civil Judge, Rajula below Ex.5 in Regular Civil Suit No.91 of 2010 to that extent and to dispose of the suit expeditiously.
2. In view of the above statement, without deciding the matter on merits, order passed by the trial court dated 30-6- 2011 by the learned Principal Civil Judge, Rajula, below Ex.5 in Regular Civil Suit No.91 of 2010 is modified to the extent that both the parties are directed to maintain status quo qua disputed property till final disposal of the suit. Looking to the peculiar facts of the case, learned Principal Civil Judge, Rajula, is directed to dispose of Regular Civil Suit No.91 of 2010 as expeditiously as possible preferably within one year from the date of receipt of copy of this order on its own merits, in accordance with law and without being influenced by the orders passed by the courts below as well as this order.
3. With the above directions, this Special Civil Application stands disposed of. Rule is discharged. Direct service is permitted.
