Mr.Pandya, learned APP waives service of notice of Rule.
The present application has been preferred by the applicant - convict for temporary bail on the ground that he wants to perform religious ceremony of his father, who has expired on 7.1.2012. The applicant is the brother of the other co-convict, Devashi Lalji Maghodiya - the applicant of Criminal Misc. Application No.192 of 2012 and for performance of the post death ceremony of their father, Devashi Lalji - eldest son - has been released on temporary bail by this Court vide order passed today in Criminal Misc. Application No.192 of 2012.
Hence, the discretion does not deserve to be exercised. Therefore, the present application is rejected. Rule discharged.
