Heard learned counsel for the petitioner and learned Standing Counsel for the State-respondent.
The petitioner is before this Court assailing the validity of impugned notice dated 11.10.2019 issued by second respondent i.e. Superintendent of Police, Rampur, whereby, the petitioner has been asked to evict the Government accommodation so allotted in his favour. Further prayer has been made not to dispossess the petitioner from the premises in question.
Learned counsel for the petitioner submits that earlier the petitioner has been transferred to GRP Lucknow from District Rampur but finally vide order dated 24.10.2019 passed by Superintendent of Police, Railway Moradabad, he has been posted at P.S. GRP Rampur but during this period, the impugned notice has been issued for vacating the premises in question and as such, this Court should come to the rescue and reprieve of the petitioner. In support of his submission, he has placed reliance on the order dated 29.01.2002 passed in Special Appeal no.36/2002 (Suman Kumar Pandey vs. State of U.P. and others).
Learned Standing Counsel fairly states that in case any appropriate representation/application is moved by the petitioner before the competent authority, the same will be considered and decided expeditiously.
With the consent of the parties and without expressing any opinion on the merits of the issue, the present writ petition stands disposed of finally with a direction to the Superintendent of Police, Rampur to look into the grievance of the petitioner and for the said purpose in case any application/representation is moved by the petitioner within two weeks time from today, definitely, the same would be looked into, examined and remedied within four weeks' further time from the date of production before him, keeping in mind the observations so made in Suman Kumar Pandey (supra). Till the disposal of said application or till expiry of said period, whichever is earlier, the status quo as of today shall be maintained by the parties.
