Heard Sri Yogesh Agarwal, learned counsel for the petitioner, learned Standing Counsel, Sri S.M. Shukla, learned counsel for the respondent no 4 and Sri Kuldeep Singh Chauhan, learned counsel appearing for respondent no. 5.
The grievance of the petitioner is that certain land of the Nagar Palika Parishad including some land of the petitioner which has been leased out to her predecessor is being illegally encroached upon by the Bhu-Mafias on the basis of some deed of transfer fictitiously got executed.
The dispute, as raised by the petitioner in the writ petition is basically of a private nature within the realm of Civil Court. As such, we do not deem it necessary to exercise our discretionary jurisdiction in the matter.
This apart, the petitioner is free to take appropriate action in the matter before the District Magistrate in accordance with the provisions of the Government Order dated 1.5.2017.
In the event petitioner so approaches, the District Magistrate shall consider the representation of the petitioner in accordance with law, most expeditiously.
The writ petition is disposed of with the above observations.
