Hemavathi vs The District Collector

Madras High Court|13 November, 2017

JUDGMENT / ORDER

This writ petition is filed challenging the notice dated 20.10.2017, calling upon the petitioner to attend an enquiry on 25.10.2017, in respect of patta proceedings.
2. I do not think that the petitioner can have any legal ground to question the very notice itself, as she could very well appear before the second respondent and give her explanation.
3. The learned counsel for the petitioner submitted that already the petitioner has attended the enquiry.
4. When that being the case, it is for the petitioner to challenge the order to be passed as on outcome of such enquiry and not to challenge the very notice itself, calling upon the petitioner to attend the enquiry. Accordingly, this writ petition is dismissed, without going into the merits of the matter, however, by granting liberty to the petitioner to challenge the final order to be passed in a manner known to law. No costs. Consequently, connected miscellaneous petition is closed.
