Despite time granted, no counter affidavit has been filed by the learned A.G.A. and the learned counsel for the informant.
The applicants were enlarged on interim anticipatory bail in this case by order dated 27.1.2021, this application is pending since then. In view of mandate of Section 438(5) Cr.P.C., it should have been decided within a month. The interim anticipatory bail order dated 27.1.2021 is confirmed. The applicants will remain on anticipatory bail as per the aforesaid and on same terms and conditions till the cognizance is taken by the court on police report under Section 173(2) Cr.P.C. and the summons are issued against the applicants.
Application is allowed.
