This application u/s 482 Cr.P.C. has been moved seeking the direction to the concerned court below to decide Case No.T201805440407643 (Hemant Kumar and others vs. Yogendra Yadv)), u/s 133 of Cr.P.C., P.S.-Kasya, District-Kushi Nagar, pending in the court of Sub Divisional Magistrate, Kasya, Kushi Nagar.
Heard learned counsel for applicant and learned A.G.A. and also perused the record.
It has been made to appear that there is some application dated 08.11.2017 moved on behalf of applicant pending in the court below but the same has not been adjudicated upon so far and a direction in that regard may be given.
In absence of complete record this Court is not in a position to know the exact status of the proceedings and also about the reasons as to why the aforesaid application has not been adjudicated so far. However, this application stands disposed of with the observation that if there is some application dated 08.11.2017 moved on behalf of applicant still pending and no orders have been passed therein so far, then the concerned court below shall look into the same and pass appropriate orders on the same expeditiously in accordance with law, as it may deem fit in the facts and circumstances of the case.
