Heard learned counsel for parties.
Petitioner is before this Court with the request to command the District Basic Education Officer, Bulahndshahar to appoint him on suitable post under Dying-in-Harness Rules 1974.
Learned counsel for the petitioner has informed to the Court that father of petitioner was working as lecturer in D.C. Inter College, Mohana, Bulandhashar and he died in harness on 31.07.2010. He further apprised to the Court that at the said point of time, the petitioner was minor and as and when he has attained the age of he has approached to the authority concerned on 15.01.2015 but no action has been taken till now whereas petitioner has completed his Graduation (B.A.) and he has also completed B.Ed. course and is eligible for the post of Assistant Teacher.
Learned Additional Chief Standing Counsel submits that in case any such claim of petitioner is still pending, the same shall be decided at the earliest by the authority concerned.
In view of the above, without expressing any opinion on the merits of the case and considering the facts and circumstances of the case, the Writ Petition is disposed of asking the District Basic Education Officer, Bulahndshahar to look into the grievance of the petitioner and pass appropriate order, as early as possible, preferably within a period of two months from the date of production of certified copy of this order.
