The fair price shop license of the petitioner was cancelled by order dated 14.09.2017.The petitioner took the order of cancellation in appeal. The appeal of the petitioner was allowed vide order dated 21.02.2018. By order dated 21.02.2018 the appellate authority remanded the matter back to the Licensing Authority for a fresh investigation and a decision in the matter. The Licensing Authority was required to complete the exercise within a period of two months after the remand.
The submission of Sri Santosh Kumar Chaubey, learned counsel for the petitioner is that the mandate of the appellate authority has not been complied with and the matter remains pending.
The sole prayer made by learned counsel for the petitioner is that the Licensing Authority may decide the matter within a stipulated period of time.
Learned Standing Counsel has no serious objection to the prayer being granted.
In view of the above submission, the respondent no. 2 is directed to decide the matter finally by passing a reasoned and speaking order after independent application of mind and in light of the direction of appellate authority within a period of one month from the date of receipt of certified copy of the order.
With the aforesaid direction writ petition stands disposed of.
