Having considered the submissions advanced by Mr.S.M.Shah, learned advocate for the appellants, so also considering the impugned order passed by the learned 3rd Additional District Judge, Kalol, on 28th April, 2012 below Exh.5 in Regular Civil Appeal No.34/11, so also considering the fact that when original suit being Special Civil Suit No.113 of 1994 was pending, as per the order passed by the Trial Court below temporary injunction application Exh.5 therein, both the parties were directed to maintain status-quo till pendency of the suit and the said order came to be confirmed by this Court vide order dated 14.03.2005 passed in Appeal from Order No.49 of 1996, Notice of Appeal from Order and of Civil Application, returnable on 21.06.2012 and in the meanwhile both the parties to maintain status-quo regarding the disputed property as prevailing today.
