High Court Of Gujarat|23 April, 2012

JUDGMENT / ORDER

1. By way of filing the present application, the applicants have prayed for directions from this court directing the respondents to return all the original documents in respect of the property in question.
2. This court is of the opinion that if the amount has been paid by the applicants to the respondents with regard to the property in question, it is the duty of the respondents to hand over the original documents to the applicants. However, this application is not appropriate recourse/remedy for the applicants. The applicants ought to have preferred contempt proceedings in case the documents are not handed over as the same amounts to violating the court's order.
3. It shall, therefore, be open to the applicants to prefer contempt proceedings in case the documents are not handed over by the respondents. Misc. Civil Application stands disposed of accordingly. This order may be communicated to the respondents for compliance at the earliest.
