It appears that this Court, when was seized with the business of Appeal From Order, an order was passed on 16th February, 2012 in Appeal from Order No. 436 of 2011 (with Civil Application No. 12074 of 2011) which also had arisen from Special Civil Suit No. 26 of 2008 and this Special Civil Application was directed to be listed along with Appeal from Order No. 436 of 2011.
Today, learned advocate Mr.Vipul Modi urges that if Appeal from Order is decided, there may not remain any need for hearing Special Civil Application at all and on account of order dated 16th February, 2012, it is not possible for him to make a request to Registry to separate the Appeal from Order. Considering the change in the business, Appeal from Order be placed before the Court concerned seized with the said business. In the event of petitioner desirous of tagging this Special Civil Application along with Appeal from Order, he may make an appropriate application for the Registry to place the same before the Hon'ble Acting Chief Justice for necessary direction.
The matter is adjourned to 6th July, 2012.
