1. This application has been filed by the applicant (original petitioner), with a prayer to restore Special Civil Application No.12153 of 2011 to its original status on file. The said petition had been dismissed for non-prosecution by order dated 02.05.2012 of this Court.
2. Heard Mr.Jay M. Thakkar, learned advocate for the applicant (original petitioner) and perused the averments made in the application. For reasons stated in Paragraphs Nos.4 and 5 of the application, the prayers made by the applicant deserve to be granted.
3. Accordingly, the application is allowed. The order dated 02.05.2012 of this Court passed in Special Civil Application No.12153 of 2011, is recalled. It is directed that the said petition be restored to its original status on file.
4. The application is disposed of, in the above terms.
