By order dated 06th August, 2012 time was granted to file affidavit-in-reply to the respondents. Today when the matter is called out, Ms.Nisha Thakore, learned Assistant Government Pleader, expressed her inability to file affidavit because of the reason that record is old and is not traceable. Such a reason can be a good ground for extension of time, but not a ground for giving exemption to respondent Authorities to file proper affidavit.
As a last chance, time is granted to file affidavit on or before 29th October, 2012. If no affidavit is filed, respondent No.3 shall remain personally present before the Court on the next date, i.e. 29th October, 2012. Copy of this order be provided to Ms.Thakore for onward communication.
