Heard learned counsel for the petitioner and Sri Rajnish Kumar Rai, learned Counsel for the respondents.
This petition has been filed for a direction upon the respondents to provide the vigilance report dated 23.4.1995, of the Eastern Railway for appointment and recruitment in Railway Protection Force. A further prayer has been made to command the respondents to reconsider the advertisement in light of the said Vigilance Report.
A perusal of the record would go to show that the recruitment process initiated in 1995 was cancelled by the Railway Protection Force. The issue of cancellation has ultimately travelled upto the Apex Court and the appeal filed by the Union of India was allowed by Hon'ble Supreme Court in a batch of petitions being Civil Appeal No.430 - 435/ 2001. The appeal filed by the Union of India was allowed and the appeals of the candidates were dismissed. The selection proceedings itself were undertaken at Calcutta. The petitioner has approached this Court with the grievance that since he is resident of Agra and had appeared in the selection and, therefore, a direction be issued for supplying him the copy of the vigilance report.
Once the issue relating to cancellation of selection has attained finality, this Court is not inclined to issue any direction so as to revive such dispute nearly after 17 years. Even otherwise, the selection proceedings having been conducted at Calcutta, no writ can be issued by this Court.
Writ petition fails and is, accordingly, dismissed.
