Heard learned Counsel for the petitioner, learned Standing counsel for the State authorities and Sri Dinesh Kumar Misra for the respondent.
Petitioner wants an award passed by the Central Government Industrial Tribunal, Kanpur in his favour to be implemented in this writ petition.
Industrial Dispute Act is a self contained code which not only recognises rights but also creates forum for its adjudication and for the enforcement of awards. In the event award has attained finality and is not being complied with by the employer remedy of the petitioner would be to move the appropriate authority as is contemplated in law. Writ Court in exercise of its power under Article 226 of the Constitution of India would not be the competent forum in getting the award executed, at the first instance.
Leaving it open for the petitioner to approach the appropriate forum, this petition is consigned to records.
