The sole relief claimed in the instant petition is for issuing a direction to the trial Court, before whom S.C.C. Suit No. 60/2009 (later came to be registered as Misc. Case No. 64/2009) is pending at the behest of the petitioner, to decide the same, within a stipulated time.
A perusal of the order sheet reveals that the matter is hanging since a long time and even as of date, the cross-examination of the plaintiff is in progress. It is also clear from the order sheet that certain transfer application is pending, but there does not appear that any stay was passed therein. On 20.10.2018, the proceedings were adjourned on application filed by the defendants on payment of cost of Rs. 500/-.
Having regard to the fact that the suit is pending since the year 2009, the instant petition is disposed of by directing the trial Court to make all endeavour to conclude the proceedings of the suit expeditiously, without granting unnecessary adjournments, provided there is no legal impediment.
