The sole relief claimed in the instant petition is for issuing a direction to the Court below, before whom S.C.C. Suit No. 50/2009 is pending at the behest of the petitioner, to decide the same, within a stipulated time.
A perusal of the order sheet reveals that the suit is pending since the year 2009. Since, last several dates, the Court is only adjourning the case without hearing the same. On last date, the matter was adjourned, as it is stated that a transfer application is pending and on account of which adjournment has been sought.
Having regard to the fact that the suit is pending since the year 2009, it is hereby directed that in case, there is no stay proceedings by any Court, the trial Court shall make all endeavour to decide the suit expeditiously, without granting adjournments on frivolous grounds.
The writ petition stands disposed of, with the aforesaid directions.
