Mazmudar, learned advocate for the applicant appellant submitted that, this Court, by orders dated 12/10/2012 in the respective First Appeals with the Civil Applications, was pleased to admitting the First Appeals and issuing Rule in the Civil Applications. The learned advocate for the applicant appellant further submitted that, inspite of all efforts, the respondent Nos. 1 and 3 have remained unserved and hence, present Civil Applications have been filed by the applicant appellant under O. 5 R. 20 of the Civil Procedure Code, 1908 seeking substituted service, by affixing the same at the last known address of respondent Nos. 1 and 3.
2. Referring the board also, it appears that rule issued by this Court has remained unserved, so far as respondent Nos. 1 and 3 are concerned. Perused the averments made in the Civil Applications and considered the same. In the circumstances, the present Civil Applications are allowed and prayer, in terms of Para 5(a) of each Civil Application, is granted qua respondent Nos. 1 and 3. Returnable date is fixed to 15th February 2013.
