The sole prayer made in the instant petition is for issuing direction to the Executing Court to decide Execution Case No. 114 of 2011 within a stipulated period.
The petitioner-bank is executing an arbitration award dated 23.04.2011 vide Execution Case No. 114 of 2011. It is not clear from the order-sheet whether the opposite parties have been served or not, though it is recorded in the order passed on 04.05.2019 that the opposite parties are not present. Counsel for the petitioner is also not in a position to say that the opposite parties have been duly served in execution proceedings.
The instant petition is disposed of by providing that in case the opposite parties are duly served, the Executing Court shall proceed in the matter with a sense of expedition having regard to the fact that the case is pending since the year 2011. The Executing Court shall ensure that no unnecessary adjournment is granted to either of the parties.
