[1] Present application is filed by two convicts through son of applicant no.1. Yesterday, learned APP could make available jail remarks qua convict no.1 - Hazraben Adambhai Varam. Therefore, the matter was kept today so as to enable learned APP to produce jail remarks qua convict no.2 - Yusuf Adambhai Varam.
[2] Rule.
Learned Additional Public Prosecutor Mr.H.K.Patel waives service of process of Rule.
[3] Learned Additional Public Prosecutor made available for perusal the Jail Remarks. On perusal of jail remarks, it is noticed that both the convicts have been released on several occasion on temporary bail and they have enjoyed furlough and parole leave also and every time, they have reported in time. There is nothing adverse recorded in the jail remarks.
[4] Taking into consideration the contents of the application, the application is allowed. The convicts are ordered to be released on temporary bail for a period of 15 days from the date of their release, on each executing a personal bond of Rs.5,000/- (Rupees Five Thousand only) to the satisfaction of the jail authorities.
[5] The convicts shall surrender to the jail authorities on expiry of the temporary bail period.
[6] Rule is made absolute to the aforesaid extent.
